1. Acceptance of Terms

By accessing and using Harissa Fit Club's website and services, you accept and agree to be bound by these Terms of Service.

2. Use of Services

Our services are intended for individuals who are at least 18 years old. By using our services, you represent that you meet this age requirement. You agree to use our services only for lawful purposes and in accordance with these terms.

3. Account Registration

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Event Participation

When registering for events, you agree to:

• Provide accurate registration information
• Follow event guidelines and trainer instructions
• Participate at your own risk and consult a physician if needed
• Respect other participants and staff

5. Chili Points Program

Chili Points are earned through participation and purchases. Points can be transferred to event coupons/vouchers that can be used toward future event registrations. Points have no cash value and cannot be transferred to other members. We reserve the right to modify the rewards program at any time.

6. Event Ticket Sales - Terms and Conditions (AGB)

The following terms and conditions apply specifically to the purchase of event tickets through Harissa Fit Club.

6.1 Ticket Purchase and Payment

• Tickets are valid only for the specified event and date(s) selected at purchase.
• Payment must be completed to confirm your registration.
• All prices are in EUR and include applicable taxes.
• Discount codes and vouchers are subject to their specific terms and availability.
• Tickets are personal and non-transferable without prior written consent.
• We reserve the right to refuse ticket sales at our discretion.

6.2 Payment Terms

• Full payment is required at the time of purchase (or reservation, if "reserve now, pay later" option is used).
• Accepted payment methods include PayPal and other methods as specified.
• If payment is not completed within the specified timeframe after reservation, the reservation may be cancelled.
• All prices are final unless a valid discount code is applied at checkout.

6.3 Cancellation and Refunds

Customer Cancellation:

• Cancellations are possible at any time before the event start time.
• Refund requests must be submitted via email to our support team.
• All refunds will be issued as event coupons/vouchers (Gutscheine) that can be used toward future event registrations, rather than cash refunds.
• Refund coupons will be processed within 5-10 business days and will be valid for future event purchases.
• Refund coupons have no expiration date and can be applied to any future event.
• Cancellation fees apply:
  • If cancellation is made more than 24 hours (1 day) before the event: A processing fee of €2.00 will be deducted from the ticket price. The remaining amount will be issued as a coupon.
  • If cancellation is made on the same day as the event (at least 2 hours before the event start time): 50% of the ticket price will be deducted. The remaining 50% will be issued as a coupon.
• For recurring events, cancellation applies to the specific date(s) selected.

Event Cancellation by Organizer:

• If we cancel an event, you will receive a full refund coupon that can be used toward any future event.
• We are not liable for any additional costs incurred (travel, accommodation, etc.).

Event Changes:

• We reserve the right to change event date, time, location, or trainer.
• If significant changes are made, you will be notified and may request a full refund coupon if the new arrangements are not suitable.

6.4 Ticket Transfer and Resale

• Tickets are personal and non-transferable without prior written consent from Harissa Fit Club.
• Resale of tickets is strictly prohibited.
• If you cannot attend, contact us to cancel and receive a refund coupon according to our cancellation policy.

6.5 Recurring Events

• For recurring workouts, tickets are valid only for the specific date(s) selected at purchase.
• You cannot transfer tickets between different dates without prior approval.
• Each date is treated as a separate booking for cancellation and refund purposes.

6.6 Discount Codes and Vouchers

• Discount codes are valid only for the specified terms and conditions.
• One discount code per transaction unless otherwise stated.
• Discount codes cannot be combined unless explicitly stated.
• We reserve the right to modify or revoke discount codes at any time.
• Discount codes have no cash value.

6.7 No-Show Policy

• If you do not attend without prior cancellation, no refund will be issued.
• To receive a refund coupon, you must cancel before the event start time according to our cancellation policy.
• Late arrivals may be denied entry at the discretion of the event organizer.

6.8 Capacity and Sold-Out Events

• Events have limited capacity as specified.
• Tickets are sold on a first-come, first-served basis.
• Once an event is sold out, no additional tickets will be available.
• We are not responsible if an event sells out before you complete your purchase.

6.9 Right to Refuse Service

• We reserve the right to refuse ticket sales or entry to any individual.
• Tickets obtained in violation of these terms may be cancelled without refund.

7. Purchases and Refunds (General)

All purchases are subject to our refund policy. Cancellations are possible at any time before the event. All refunds are issued as event coupons/vouchers (Gutscheine) that can be used toward future event registrations, rather than cash refunds. Cancellation fees apply: €2.00 fee if cancelled more than 24 hours before the event, or 50% deduction if cancelled on the same day (at least 2 hours before the event start time).

8. Intellectual Property

All content on this website, including logos, images, and text, is the property of Harissa Fit Club and protected by copyright laws.

9. Photography and Media

By purchasing a ticket and attending events organized by Harissa Fit Club, you consent to being photographed and/or videotaped during the event. You acknowledge that Harissa Fit Club may use these photographs and videos for promotional purposes, including social media posts, website content, marketing materials, and press releases.

All photographs and videos taken at Harissa Fit Club events are the property of Harissa Fit Club. We retain all copyright and usage rights to these materials.

If you wish to have a photograph or video of yourself removed from our platforms, you may request deletion by contacting us at hello+legal@harissafitclub.com. We will review and process deletion requests in accordance with applicable data protection laws (GDPR/DSGVO). Please note that images already used in printed materials may not be removable, and deletion requests will be processed within 30 days.

If you do not wish to be photographed, please inform our staff at the event check-in, and we will make reasonable efforts to avoid photographing you.

10. Limitation of Liability

Harissa Fit Club is not liable for any injuries, damages, or losses arising from participation in our events or use of our services. Participants assume all risks associated with physical activities.

11. Force Majeure

We are not liable for failure to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government restrictions, or other force majeure events. In such cases, we will attempt to reschedule events or provide refunds as appropriate.

12. Changes to Terms

We may update these terms from time to time. Continued use of our services after changes constitutes acceptance of the new terms.
